Terms and conditions of sale

Last updated: 20 October 2026

This is an English translation of our French terms and conditions of sale, provided for convenience. In the event of any discrepancy, the French version prevails.

Preamble

These terms and conditions of sale (the "Terms") govern any order placed by a customer (the "Customer") with Le 19e Trou (the "Seller") on www.le19emetrou.fr. Placing an order implies full acceptance of these Terms. The Seller may amend the Terms at any time; the applicable Terms are those in force on the date the order is confirmed.

1. Seller

Le 19e Trou is a micro-enterprise operating in France. Full details (company name, SIRET number, address, email) are given in the legal notice. Contact: contact@le19emetrou.fr.

2. Product

The product offered is Le 19e Trou, a golf-themed bottle opener (base, opener and club in sturdy plastic), sold at €34.99 including tax per unit (VAT not applicable, article 293 B of the French General Tax Code). Delivery is free. The Seller makes every effort to describe the characteristics (material, dimensions, weight, operation) as accurately as possible. Slight cosmetic variations may nevertheless occur from one batch to another without constituting a defect.

3. Order

Orders are placed online through the site. The Customer should check the contents of the basket, the quantity and the delivery address before final confirmation. Order confirmation, with an order number, is sent by email to the address provided. The Seller may cancel or refuse any order for a legitimate reason (out of stock, suspected fraud, clearly incorrect address).

4. Prices and payment

Prices include all taxes, with free delivery. Prices are displayed and charged in the currency selected by the Customer from those offered on the site; the amount shown at checkout is the amount charged. Payment is made online via the secure Stripe solution (PCI-DSS level 1): card, Apple Pay, Google Pay or Stripe Link. Le 19e Trou does not store any card data. The order is confirmed once payment has actually been received. If the bank refuses the payment, the order is cancelled.

5. Delivery

We deliver to the address given at checkout, in the following countries: metropolitan France (including Corsica), Monaco, all European Union member states, the United Kingdom, Switzerland, Norway, Iceland, the United States, Canada, Australia, New Zealand, Japan, Singapore, Hong Kong, South Korea, Taiwan, Israel, the United Arab Emirates, South Africa, Brazil and Mexico. Shipping is free. A tracking number is emailed as soon as the order ships.

Delivery: no later than 30 days from the order.

Risk of loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier proposed by us, take physical possession of the goods (Article L. 216-4 of the French Consumer Code).

If the goods are not delivered by that date, you may, after asking us in writing (by registered letter with acknowledgement of receipt or on another durable medium such as an email to contact@le19emetrou.fr) to deliver within a reasonable additional period, terminate the contract if we have not delivered within that period. The contract is terminated when we receive your letter or email informing us of the termination, unless we have delivered in the meantime. You may also terminate the contract immediately if we refuse to deliver, or fail to deliver by the agreed date where that date was essential for you (Article L. 216-6 of the French Consumer Code). All sums paid are then refunded no later than 14 days after the termination (Article L. 216-7).

6. Right of withdrawal

You have 14 days from the day you, or a third party designated by you other than the carrier, receive the goods to withdraw from the contract without giving any reason (Articles L. 221-18 et seq. of the French Consumer Code). For several goods delivered separately, the period runs from receipt of the last item.

To exercise this right, inform us before the period expires of your decision to withdraw by an unequivocal statement, for example by email to contact@le19emetrou.fr, using the model withdrawal form below or any other statement. Then send the goods back without undue delay and no later than 14 days after informing us of your decision, to the return address we email you.

The direct cost of returning the goods is borne by you (flat fee of €6). The goods do not need to be returned in their original packaging. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

We will refund all payments received from you, including the initial delivery costs, no later than 14 days from the day we are informed of your decision to withdraw, using the same means of payment as you used for the order unless you expressly agree otherwise. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them back, whichever is earliest.

7. Legal guarantees

All products are covered by the 2-year legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and by the legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). To make a claim, contact our email support at contact@le19emetrou.fr.

Article 1641 of the French Civil Code: “The seller is bound to a warranty against hidden defects of the thing sold which render it unfit for the use for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would only have paid a lower price for it, had he known of them.”

Article 1648, paragraph 1, of the French Civil Code: “An action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.”

Information on the legal guarantees (translation of the model notice annexed to Article D. 211-2 of the French Consumer Code)

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.

The legal guarantee of conformity obliges the trader, where applicable, to provide all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the initial guarantee is extended by six months.

If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

1. the trader refuses to repair or replace the goods;

2. the repair or replacement takes place after a period of thirty days;

3. the repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;

4. the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case the consumer does not have to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The rights set out above result from Articles L. 217-1 to L. 217-32 of the French Consumer Code (Code de la consommation).

A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

8. Liability

The product is intended for household use to open bottles with crown caps. Any use not in line with its purpose (dangerous handling, deliberately launching the cap at a person, modifying the product) is at the Customer's own risk and excludes the Seller's liability. The Customer must use the product sensibly and in line with basic safety rules.

9. Force majeure

The Seller cannot be held liable for any delay or failure resulting from force majeure within the meaning of article 1218 of the French Civil Code (natural disaster, carrier strikes, failure of a subcontractor beyond the Seller's control, etc.). In that case, time limits are suspended for the duration of the force majeure.

10. Personal data

Data collected for orders is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. Details of processing, purposes, retention periods and the Customer's rights are set out in the privacy policy.

11. Mediation and disputes

In accordance with article L.611-1 of the French Consumer Code, if a dispute cannot be settled amicably, the Customer may use a consumer mediator free of charge.

These terms are governed by French law; consumers keep the mandatory protections of the law of their country of residence. In the event of a dispute, the consumer may bring proceedings, at their choice, before any court with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they lived when the contract was concluded or when the harmful event occurred (Article R. 631-3 of the French Consumer Code).

12. Governing law

These Terms are governed by French law. The language of the contract is French.
